Although your employer can’t change its staging date, it can delay the date it intends to enrol you into its pension scheme by up to three months. This is known as ‘postponement’. Your employer must tell you about the delay in writing. If you want to join the workplace pension scheme before this date your employer must make sure you are able to (you’ll need to contact your employer if you want to do this).

  • pay at least the minimum contributions due to the pension scheme on time
  • let you leave the pension scheme (called ‘opting out’) if you ask – and refund money you’ve paid, but only if you opt out within 1 month
  • let you re-join the scheme at least once a year if you’ve opted out
  • automatically re-enrol you back into the pension scheme at least once every 3 years if you’ve opted out, ceased active membership or are paying below the minimum contribution levels, providing you’re still classed as an ‘eligible’ jobholder.

The Pensions Regulator is responsible for ensuring compliance with the automatic enrolment legislation; where there’s a breach it’ll initially focus on education rather than imposing fines for non-compliance.

If your employer doesn’t meet its duties, The Pensions Regulator will initially just tell them to put things right. Any further failure may lead to the government fining your employer a lot of money. In the event of persistent and deliberate non-compliance, The Pensions Regulator can issue increasing penalty notices of up to £10,000 a day. Ultimately your employer could face criminal prosecution and even imprisonment.

Payments haven’t been made to my workplace pension scheme.   • passed the contribution deducted from your salary to your pension scheme.

If your employer is behind with payments, we’ll initially get in touch with them to let them know that a payment is overdue.  If payments are more than 90 days late after the due date (this is the 22nd of the following month after contributions have been deducted from their salary), we’ll report this as a breach to The Pensions Regulator, and we’ll write to both you and your employer to inform you of this.

If you’re concerned, the most effective step is to discuss your concerns with your employer. If this is unsuccessful, you can anonymously report your employer to The Pensions Regulator through its whistleblowing service.

If you have a contract to perform work or services for an agency, then you’ll be eligible for auto- enrolment in your agency’s scheme (this depends on your earnings level and age). However, sometimes agencies provide workers who are genuinely self-employed and such workers are excluded from being enrolled under the rules.
